1. About These Terms

The Gym in Worcester was started as a collaboration between De Jagers Uitrusters and the community of Worcester. This is a long-term investment in Worcester, and we strive to provide a professional and pleasant environment for all our members. In return, we ask members to abide by the terms set out below.

This page is a summary of the terms that apply to every member of The Gym (“the Facility”, “the Company”). The full membership agreement, including your specific package, payment details and signature, is signed in person at the gym when you join. Where anything on this page differs from your signed membership agreement, the signed agreement takes precedence.

Facilities, equipment, hours, services, rules and policies are subject to change from time to time, at the sole discretion of The Gym, without prior notice. By remaining a member, you agree to accept such reasonable changes as a condition of membership.

2. Facility Rules & Conduct

  • Members must be at least 18 years old, unless authorised by The Gym or accompanied by written consent from a parent or legal guardian.
  • Membership is for the named member only and may not be shared with or used by anyone else. Violating this may result in immediate termination of membership.
  • Equipment must only be used in the manner and for the purpose it is intended, following guidelines posted in the Facility. Do not move exercise equipment without authorisation.
  • Please wipe down equipment after each use with the supplies provided, and don't occupy equipment for extended periods when others are waiting.
  • Appropriate gym attire is required — gym shorts, T-shirts, tracksuits, aerobic wear and sweat outfits. Street clothing and jeans are not permitted. Bring a towel to protect and clean equipment during your workout.
  • Members should conduct themselves in a quiet, well-mannered fashion that doesn't interfere with other members' use of the Facility. Profanity, indecent language, and offensive, potentially harmful, dangerous or abusive conduct will not be tolerated and may result in termination of membership.
  • Alcohol, drugs (including steroids) and smoking are prohibited within the Facility. Members must not use the Facility while under the influence of drugs, alcohol, or medication that may impair their ability to safely use the equipment. No weapons, gambling or gaming are permitted on the premises.
  • Photography, videotaping, filming or audio recording within the Facility requires express written consent from The Gym management.
  • The Gym is not responsible for any lost or stolen items.

3. Assumption of Risk & Liability

By becoming a member of The Gym, you acknowledge and agree that:

  • The Gym will not be liable for death, injury, loss or damage suffered by you arising from any cause whatsoever, including any negligent act or omission or breach of contract on the part of The Gym, its directors, shareholders, employees, contractors, independent consultants or other members, to the fullest extent permitted by law.
  • You enter and exit the premises (including the parking area) and use the equipment and Facility entirely at your own risk.
  • The Gym is not vicariously liable for any loss or damage you or other members suffer as a result of theft by its employees, independent contractors, consultants, or other members.
  • You (and your estate, where applicable) indemnify The Gym against any claim arising directly or indirectly from your death, injury, loss or damage, allegedly caused or contributed to by any act or omission of The Gym, its directors, shareholders, employees, contractors, consultants, tenants, other members or agents.
  • The Gym will not be held responsible for any injuries suffered while attending group training classes or elsewhere on The Gym premises.

It is your responsibility to consult a healthcare provider before beginning this or any exercise programme, in respect of any past or present injury, illness, health problem, condition or medication that may affect your participation at any point in time.

4. Payments & Fees

  • Your first payment is made by card or cash at your first training session (after orientation), with future payments due each month thereafter.
  • The Gym reserves the right to increase tariffs on a yearly basis. Any increase will be communicated to members at least one month before it takes effect.
  • If you pay by debit order, you authorise The Gym (via its payment processor) to collect payment instructions from your bank account for all fees, expenses and other monies due, in accordance with the debit order mandate you sign as part of your membership agreement. Cancelling a debit order mandate does not cancel your membership agreement, and amounts legally owed to The Gym cannot be reclaimed once paid.
  • Bounced or failed payments incur a R250 penalty charge per occurrence.

5. Membership Term, Auto-Renewal & Cancellation

  • Membership spots are limited. Your membership automatically renews on a month-to-month basis after your initial contracted term expires, until a valid written cancellation notice is received.
  • You're free to cancel at any time after your initial 12-month commitment, subject to 30 days' written cancellation notice (“I QUIT”) emailed to The Gym management (see Section 6). If notice isn't given within this grace period, you remain liable for that month's payment.
  • Cancellation within the 12-month commitment is at the sole discretion of management, and is generally only permitted where a member relocates to another town or city, or must stop due to a medical condition or other good reason. Proof must be supplied to management.
  • Early cancellation without a qualifying reason, or a payment freeze/cancellation without prior notification to The Gym, may incur a cancellation fee of 50% of the balance of the remaining months on your contracted membership.

6. Official Communication Channel

All official communication with The Gym — and in particular any request to cancel or freeze your membership — must be submitted in writing by email to thegym@dejagers.co.za. Messages sent via WhatsApp, Facebook, Instagram or any other social media platform are not accepted as valid notice and will not be actioned. A cancellation or freeze is only considered received once confirmed by email, and the notice periods described in these terms run from the date that email is received.

7. Freezing Your Membership

Members may freeze (temporarily suspend payment on) their membership for up to 4 months. This is granted at management's discretion, typically for a medical condition or a temporary relocation to another town. Proof of the condition or move, and the freeze request itself, must be submitted by email as described in Section 6.

8. Rescheduling & Missed Sessions

Missed sessions do not carry over into the following week or phase. You're responsible for attending your scheduled training sessions, and group training classes have limited availability.

9. Changes to These Terms

We may update these terms from time to time to reflect changes to our facilities, services or policies. The “last updated” date at the top of this page reflects the most recent revision.

10. Governing Law

These terms are governed by the laws of South Africa.
